This Hold Harmless Agreement (the "Agreement") is entered into on this day by and between Greater Impact, Inc. ("Organization"), a nonprofit organization, and the undersigned volunteer ("Volunteer").
1. Assumption of Risk
The Volunteer acknowledges that they have voluntarily chosen to participate in the activities organized by Greater Impact, Inc. The Volunteer understands and accepts the risks associated with volunteering, including but not limited to any physical injuries, emotional distress, or property damage that may arise from participation in such activities.
2. Release and Hold Harmless
The Volunteer, on behalf of themselves, their heirs, assigns, and legal representatives, hereby fully and forever releases, discharges, and agrees to hold harmless Greater Impact, Inc. its officers, directors, employees, agents, volunteers, and all other persons or entities acting on behalf of the Organization (collectively, the "Released Parties"), from any and all claims, demands, actions, or causes of action arising out of or related to any injuries, damages, losses, or other liabilities incurred as a result of their participation in volunteer activities, except for those arising from the gross negligence or willful misconduct of the Released Parties.
3. No Liability for Medical Treatment
In the event of an injury or medical emergency, the Volunteer consents to receiving necessary medical treatment, and agrees to bear the costs of such treatment. The Volunteer understands that Greater Impact Inc., does not provide any medical insurance coverage for injuries sustained during volunteering.
4. Use of Likeness
The Volunteer grants permission to Greater Impact, Inc. to use their name, image, voice, and likeness in any photographic, video, or digital recordings made during their volunteer service. This includes, but is not limited to, use in marketing materials, social media posts, website content, newsletters, fundraising campaigns, and any other promotional efforts by the Organization. The Volunteer acknowledges that they will not be entitled to any compensation for such use and waives any right to inspect or approve the finished product.
5. General Provisions
(a) Entire Agreement: This Agreement contains the entire understanding between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, or representations, whether written or oral.
(b) Severability: If any provision of this Agreement is determined to be invalid or unenforceable by a court of competent jurisdiction, the remainder of this Agreement shall remain in full force and effect.
(c) Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of laws principles.
(d) Voluntary Agreement: The Volunteer acknowledges that they have read this Agreement carefully, understand its contents, and voluntarily accept the terms set forth herein.
